Socialist Party Put on Ohio Ballot by Federal Court On August 21, U.S. District Court Judge Edmund Sargus issued an order putting the Socialist Party on the Ohio ballot. Specifically, Brian Moore for president and Stewart Alexander for vice-president will be listed on the November ballot with "Socialist" next to their names. Moore v Brunner, 2:08cv-224. The Ohio Green Party knows about this decision and hopes to gain the same sort of relief for itself. Judge Sargus said about the Socialist Party, "The Court finds that the Socialist Party USA has the requisite community support to be placed on the ballot in Ohio based on the following undisputed facts in the parties' memoranda. Socialist Party USA has a century-long history of involvement in presidential politics. The party held its last bienniel convention in St. Louis, Missouri, in October 2007, at which time it nominated Moore and Alexander as its candidates. Socialist Party candidates appeared on the ballot in 8 states in the 2004 presidential election, and garnered 10,822 votes nationwide. For the upcoming 2008 election, plaintiffs Moore and Alexander have currently qualified in Vermont, New Jersey and Colorado and are actively seeking ballot access in 18 other states, including Ohio. As for a showing of support in Ohio, the Socialist Party has "an active state affiliate in Ohio with a Charter and state officers" since at least 1999. The party has gathered several thousand signatures of Ohio residents." This is the first time the Socialist Party has ever won a ballot access lawsuit in federal court. The party won many ballot access lawsuits in state courts, in the period 1900-1948. The party also won a federal lawsuit in Iowa in the 1980's, to win the right of its members to serve as deputy registrars of voters, but that was not a ballot access case... read more. Socialist Party Uses Obscure Method to Get on Iowa Ballot This year, the Socialist Party used an almost-forgotten method for getting its presidential candidate on the Iowa ballot. Iowa gives statewide minor party and independent candidates a choice of either submitting 1,500 signatures, or attracting 250 voters to a meeting. The latter method seems difficult, and as far as is known, no one had used it since 1968, when it only required 50 attendees. However, recently the Secretary of State ruled that the 250-person meeting requirement may be satisfied by holding a meeting at an outdoor location. The Socialist Party set up its meeting at an outdoor spot on the campus of the University of Iowa. That spot had lots of pedestrian traffic. Persons walking by were asked to sign, and that person was considered an attendee. Washington state has a similar relaxed attitude toward what constitutes a "meeting". By contrast, Oregon has a very rigid idea about such meetings. Oregon has a 1,000-person attendence alternative for statewide independent candidates, but all 1,000 voters must be in a room simultaneously, or the meeting is invalid... read more. Ohio Court Hearing on Socialist Party Ballot Access On August 15, a U.S. District Court in Ohio conducted a hearing by telephone in the Socialist Party's ballot access case. The case is called Moore v Brunner. The first half of this case, back in June, had resulted in an injunction letting out-of-staters circulate independent petitions in Ohio. Then the complaint had been amended, to ask that the Socialist Party be recognized as a party in Ohio, since the Ohio law on how a party is recognized is void. The case was then transferred to a different judge (i.e., the same judge who had put the Libertarian Party on the ballot in July). A decision is expected early next week. If the Socialist Party gets on the ballot in Ohio, it will be the first time the word "Socialist" has appeared on an Ohio ballot since 1972, when the Socialist Labor Party last appeared on the Ohio ballot... read more. Socialist presidential candidate visits UCF The socialist candidate for the U.S. presidency spoke at UCF Wednesday to discuss social, economic and political issues, socialism and what he believes is the imminent fall of capitalism in the U.S. Brian Moore of Socialist Party USA was invited to speak by Jay Jurie, an assistant professor of public administration and the faculty adviser to Students for a Democratic Society at UCF. Freedom Socialist Party Helps Petition for Socialist Party The Freedom Socialist Party has never run a presidential candidate, nor even a candidate for statewide office, in any state. Instead, it has limited its electoral campaigns to state legislative races, and races for local office, in Washington, Oregon, California, and New York. This year, however, the Freedom Socialist Party is actively helping the Socialist Party place Brian Moore on the Washington ballot. Moore is the Socialist Party's presidential nominee. This will probably guarantee Moore a spot on the ballot in Washington. The Socialist Party last placed a presidential nominee on the Washington ballot in 2000, when only 200 supporters were needed. The requirement since 2004 has been 1,000 supporters. This story can be found online at www.ballot-access.org. Ohio Victory On June 2, U.S. District Court Judge Gregory L. Frost issued an injunction against an Ohio election law that restricts who can circulate independent candidate petitions. The injunction says the law, barring out-of-staters from circulating an independent candidate petition, is probably unconstitutional. While the case is pending, the law cannot be enforced. Moore v Brunner, 2:08cv-224. On June 6, Ohio officials said they would not appeal the injunction. Ohio does not automatically have a law that bars out-of-state circulators for independent candidates. Instead, it has an even more restrictive law that says circulators for an independent candidate must be registered voters. That is obviously unconstitutional, because in 1999 the U.S. Supreme Court ruled in Buckley v American Constitutional Law Foundation that states cannot require circulators to be registered voters. Ohio tried to persuade Judge Frost to interpret the Ohio law so that Ohio residents could circulate for an independent but that out-of-staters couldn't. But the Judge didn't do that, which would have required him to, in a sense, re-write the law. The case had been brought by Brian Moore, presidential nominee of the Socialist Party. This is the first constitutional election lawsuit that the Socialist Party has filed in over ten years. The Ohio restriction on who can circulate for an independent candidate is particularly silly, since Ohio lets any adult (regardless of residence) circulate a petition for a new or previously qualified political party. Reporter Jamie Kidder from WMNF 88.5 FM Community Radio interviewed representatives of the AFL-CIO union in coordination with the Progressive Democrats of America, who were supporting Democratic candidate Barack Obama, plus a smaller contingent of Senator John McCain supporters and Socialist presidential candidate Brian Moore. Brian Moore Wins Injunctive Relief Against Ohio Petition Restriction On June 2, Brian Moore (Socialist Party presidential candidate) won injunctive relief from U.S. District Court in Columbus, against an Ohio law that requires independent candidate petition circulators to be registered voters in Ohio. Moore v Brunner, southern dist., 2:08cv-224. Although the law has not yet been declared unconstitutional, while that part of the case is pending, any adult may circulate an independent candidate petition in Ohio. Ohio tried to persuade the judge that even if he issued an injunction against the registration requirement, he should still let the state bar out-of-state residents from circulating an independent candidate petition. But the judge rejected the state's plea. Although a theoretical in-state residency requirement might be constitutional, the judge said, Ohio has no such law on the books. Mr. Nolan seemed to enjoy the interview as it became very engaging for him and his callers as Gary kept extending the interview time. The station hosts very conservative Fox News commentators Bill O'Reilly and Sean Hannity, CNN's Glenn Beck, Neal Boortz, Michael Savage and The Savage Nation, Dennis Miller and Gary Nolan's "The Drive" program from 4 to 6 PM Central time. Brian was interviewed from 6:05 thru 6:45 PM Eastern Time, or one hour earlier on Nolan's Central Time. Gary Nolan has been the host of two nationally-syndicated radio shows, based in Washington, DC. Brian Moore Interviewed at Debate Protest Brian participated with colleagues from his antiwar group in the CNN/YouTube Republican Debate protest Wednesday evening, 28 November, in St. Petersburg, Florida. There were approximately 400 to 500 protesters demonstrating in front of the Maheffey Theater in St. Petersburg where the debate occurred. The Tampa Bay Community Television Network, which has about a 400,000 plus audience base potential, interviewed Brian at the event for about 7 of the 14 minute tape that they have posted exclusively on their website. Brian was able to address issues at length of the Socialist Party also. The tape includes filming the protestors, police, demonstrators getting arrested, Brian's and two other interviews. The confrontation was an exclusive taping, and the rest of the media apparently has snatched up copies of the confrontation and arrests, which include Brian's interview. Socialist Party Ticket is Moore-Alexander The Socialist Party nominated Brian Moore of Florida for president, and Stewart Alexander of California for vice-president, at the St. Louis convention. The final presidential vote was 25 for Moore and 20 for Eric Chester of Massachusetts. Inasmuch as Alexander is also a member of the Peace and Freedom Party, this may be the best opportunity the Socialist Party ticket has ever had to also win the Peace and Freedom nomination.
